These Terms of Service (“Terms”) govern your use of programs.bay-studios.com (the “Service”), operated by Bay Studios Oy (Business ID 2843231-5) (“Bay Studios”, “we”, “us”, “our”).

By creating an account, purchasing access, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service

The Service provides digital training content and related features, which may include lessons, quizzes, assignments, certificates, and (where enabled) community features.

We may update, change, or remove parts of the Service over time.

Accounts and access

You must provide accurate information and keep your login credentials secure. You are responsible for all activity under your account.

You must not share your account, resell access, or allow others to use your login.

We may suspend or terminate access if we reasonably believe you have violated these Terms, misused the Service, or created a security, legal, or operational risk.

Purchases, access terms, and delivery

The Service may be offered as one-time purchases, time-limited access, and/or subscriptions, as described at checkout. The information shown at checkout (including price, access duration, included features, and any limitations) forms part of the contract.

Some programs may provide immediate access after payment; others may start on a later date or follow a defined schedule, as stated at checkout.

Payments

Payments are processed by a third-party payment provider. We do not store full card details.

Consumer right of withdrawal

If you are a consumer, online purchases generally include a 14-day right of withdrawal unless an exception applies.

For digital content not supplied on a tangible medium, the right of withdrawal may be lost once delivery/performance begins if you give prior express consent and acknowledge that you lose the right of withdrawal.

Where required, we will request this consent/acknowledgement at checkout or before access starts.

Nothing in these Terms limits mandatory consumer rights.

Refunds, disputes, and abuse

Except where required by mandatory law:

• Fees are non-refundable once digital content access has started / been delivered.
• If access is suspended or terminated due to a material breach (including unauthorized sharing, redistribution, or fraudulent use), no refund is due.
• If you initiate a payment dispute or chargeback, we may suspend access while the dispute is investigated.

Intellectual property and license

All content and materials provided by Bay Studios through the Service (including videos, text, templates, exercises, course structure, and certificates) are owned by Bay Studios and/or its licensors and protected by intellectual property laws.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service content solely for your own learning during your access period.

You must not, and must not help others to:

• copy, record, screen-capture, download (except where explicitly enabled), distribute, publish, transmit, sell, sublicense, or share any Service content
• make the content available to the public or to any third party
• circumvent access controls, security features, or technical restrictions
• use automated tools to scrape, capture, or bulk-download content

Unauthorized sharing or redistribution is a material breach and may result in immediate suspension/termination and legal action.

Preview/sample lessons and materials remain Bay Studios content and are subject to the same restrictions.

Acceptable use

You must not use the Service unlawfully or in a way that infringes rights (including privacy and IP), harms others, or interferes with the Service (including hacking, malware, or disruption).

User submissions and community

If you submit content (e.g., assignments) or post in community features:

• You retain ownership of your content.
• You grant Bay Studios a non-exclusive license to host, store, reproduce, and display it only as needed to operate the Service (e.g., delivering features, grading/review, certificates, support).
• You are responsible for ensuring you have the rights to submit any content you upload.

Health and safety

Training content is provided for educational purposes. You are responsible for your own health and safety and for seeking professional advice where appropriate. The Service does not provide medical advice.

Disclaimers and limitation of liability

To the maximum extent permitted by law, the Service is provided “as is” and “as available”.

To the extent permitted by law, Bay Studios is not liable for indirect or consequential damages. Bay Studios’ total liability relating to the Service will not exceed the amount you paid for the relevant purchase in the 12 months before the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited under mandatory law.

Privacy

Personal data is processed as described in our Privacy Policy.

Governing law and disputes

These Terms are governed by the laws of Finland, without prejudice to mandatory consumer protections that may apply in your country of residence.

Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page and update the “Last updated” date. Continued use of the Service after an update means you accept the updated Terms.

Payments

Payments are processed by Stripe. We do not store full card details. Stripe processes payment and related data needed to complete transactions and help prevent fraud.

Sharing of personal data

We share personal data only as necessary to operate the Service, for example with service providers that support:

• Hosting and infrastructure: currently Kinsta (EU/Finland) and related infrastructure partners required to operate the hosting environment
• Payments: currently Stripe
• Customer support and communications: currently Intercom

We may also share data with professional advisers (such as accountants) and authorities where required by law. We use appropriate contractual protections (including data processing terms) with relevant service providers.
